By accessing or purchasing TBredIQ ("Service", "we", "us", "our"), you ("Subscriber", "you") agree to these Terms of Service. If you do not agree, do not use the Service.
Section 02
TBredIQ publishes thoroughbred race intelligence: ranked analytical outputs, written commentary, and supporting data tables for selected race cards. The Service is a digital information product. It is not financial advice, investment advice, wagering advice, or a recommendation to place any wager. See our Disclaimer.
Section 03
You must be of legal age in your jurisdiction. You are responsible for keeping your credentials secure and for activity on your account. One person, one account. We may suspend or close accounts for fraud, abuse, or material breach of these Terms.
Section 04
Subscriptions renew automatically until canceled. Cancel anytime in your account settings; cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy. Prices are stated on the subscriptions page and may change with at least 30 days’ notice for existing subscribers.
Payments are processed by Stripe. Sales tax or VAT may be added where required by law.
Section 05
All content on the Service — analytical outputs, written commentary, code, design, structured data — is owned by TBredIQ or our licensors and protected by copyright and other intellectual-property laws.
We grant you a personal, non-transferable, non-exclusive license to access and use the content for your own informational purposes. You may share short excerpts with credit and a link back. You may not republish substantial portions, scrape the Service for resale, or train commercial models on our outputs without prior written permission.
Section 06
Don’t do anything illegal. Don’t hammer the API beyond the published rate limit. Don’t reverse-engineer authentication or paywalls. Don’t share your account credentials with others. Don’t resell access. We may revoke access for any of these without refund.
Section 07
The Service is provided "as is" and "as available." We make no warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analytical output will produce a winning, profitable, or specific result.
Section 08
To the maximum extent permitted by applicable law, TBredIQ’s total liability arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid TBredIQ in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100). We are not liable for indirect, incidental, consequential, special, or punitive damages.
Section 09
You agree to indemnify and hold harmless TBredIQ from claims arising out of your breach of these Terms, your misuse of the Service, or your violation of applicable law.
Section 10
You may terminate your account at any time. We may terminate or suspend access for material breach, fraud, or sustained inactivity, with reasonable notice where practicable. Sections that by their nature should survive termination — ownership, disclaimers, liability limits, governing law — survive.
Section 11
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where mandatory consumer-protection law in your jurisdiction requires otherwise.
Section 12
We may update these Terms. Material changes will be announced on the site and to subscribed users by email at least 30 days before they take effect. Continued use after the effective date is acceptance.
