Terms of Service
1. Acceptance
By accessing or purchasing TBredIQ ("Service", "we", "us", "our"), you ("Subscriber", "you") agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
TBredIQ publishes thoroughbred race intelligence: ranked selections, written analysis, and supporting tables for selected race cards. The Service is a digital information product. It is not financial advice, investment advice, wagering advice, or a recommendation to place any wager. See our Handicapping Disclaimer.
We are not a sportsbook, casino, or advance deposit wagering operator. We do not accept wagers, hold funds for wagering, or facilitate wagering transactions.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to purchase the Service. You must be of legal age to wager on thoroughbred racing in your jurisdiction if you intend to use our analysis in connection with any wagering activity. The Service is intended for users in the United States; we make no representation that the Service is appropriate or available in any other jurisdiction.
4. Pricing and Payment
Prices for individual cards and packs are listed on the purchase page in U.S. dollars. Payment is processed by Stripe, Inc. We do not store full payment card numbers on our servers. You authorize us, through Stripe, to charge the payment method you provide for the products you select.
The free Thurby card is delivered after email confirmation only. Email-gated content is provided for your individual use.
5. Delivery
Paid race cards are delivered by email on the morning of the relevant race day on a published schedule. Delivery times are targets, not commitments. Brief delays caused by upstream data feeds, email infrastructure, or force majeure events do not constitute breach of these Terms.
If a card is not delivered by the stated cutoff time on race day due to our error, you may request a refund under our Refund Policy.
6. Refunds
Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference.
7. Intellectual Property
All content produced by TBredIQ — including our race cards, written narrative, ranking output, branding, and any proprietary figures or summary statistics — is owned by TBredIQ and protected by U.S. and international copyright and trademark law. You receive a personal, non-transferable, non-exclusive license to view and use the content for your own analysis. You may not redistribute, resell, repost, scrape, or republish our content, in whole or in substantial part, without our prior written consent.
8. Acceptable Use
You agree not to (a) share, resell, or distribute paid content, (b) use the Service to develop a competing product, (c) attempt to access the Service by any means other than the interface we provide, (d) interfere with or disrupt the Service, or (e) use the Service for any unlawful purpose.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis will produce any specific result.
10. Limitation of Liability
To the maximum extent permitted by law, in no event will TBredIQ, its officers, employees, or contractors be liable to you for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wagers, or lost data, arising out of or related to your use of the Service. Our total cumulative liability for any claim arising out of or related to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless TBredIQ from any claim arising out of your breach of these Terms or your misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for breach of these Terms or for any other reason. On termination, sections 7 through 13 survive.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms is subject to the exclusive jurisdiction of the state and federal courts located in Williamson County, Tennessee.
14. Changes
We may update these Terms from time to time. The current version is always available at this URL with the most recent effective date. Continued use of the Service after changes take effect constitutes acceptance.
